Supreme Court criticises Centre for not filling up tribunal vacancies, warns of contempt

The Supreme Court today came down heavily on the Centre for not respecting decisions of the apex court on the issue of appointment of tribunal members and chairpersons.”You are emasculating the tribunals,” said a bench of CJI N V Ramana and Justices D Y Chandrachud and L N Rao.The court warned the Centre of contempt if it fails to comply with its recommendations.

“We do not want confrontation with the government but we will be left with no option but to either close down the tribunals or take over the appointments and initiate contempt if the government does not implement the recommendations,” the top court said. The apex court has repeatedly expressed its displeasure over Centre’s failure to make appointments to tribunals despite the recommendations given by the selections committee. The Court also criticised the Centre for enacting Tribunal Reforms Act as the provisions are similar to what the court had already struck down.
